Tyler Insurance Filings simplifies compliance for state and federal filings

Published: October 16, 2024

At Tyler Insurance Filings, we are committed to staying ahead of the curve when it comes to regulatory compliance for insurance companies managing filings on behalf of motor carriers. As part of this commitment, we are announcing several key updates to two critical forms—Form H, Uniform Motor Carrier Cargo Certificate of Insurance, and the MCS-90, Endorsement for Motor Carrier Policies of Insurance for Public Liability.

One significant update to Form H is the requirement to include liability limits for filings to Louisiana. This allows the jurisdiction to confirm that permit holders are meeting the state's minimum insurance coverage requirements.

Tyler Insurance Filings is specifically designed to manage these varying requirements seamlessly. Our platform simplifies the filing process by automatically adjusting to state-specific requirements and ensuring that users are prompted only for the information that is necessary for a particular filing. For example, when filing in Louisiana, users will be prompted to include liability limits for the Form H, whereas for Pennsylvania, liability limit information is not required and collected on an optional basis. This automated adjustment is part of our broader commitment to making the filing process as straightforward as possible for our users, while still adhering to each state's unique regulatory demands.

In addition to the updates to Form H, there has also been an update to the MCS-90 form, which is required by the Federal Motor Carrier Safety Administration (FMCSA) for interstate carriers. The MCS-90 form now has a new expiration date of June 30, 2027. The expiration date pertains to the procedure for renewing the Information Collection Request with the Office of Management and Budget. However, the obligation to collect the information specified in this form does not have an expiration date. The latest MCS-90 form is available through Tyler Insurance Filings and serves as a critical component of a motor carrier's compliance with FMCSA regulations, particularly in ensuring that the carrier meets the necessary financial responsibility requirements. Failure to meet reporting requirements could result in compliance issues, which could have serious consequences for both the insurance company and the motor carrier.

These system updates reflect our commitment to providing tools that simplify the filing process and help filers stay informed about form updates and rule changes. We encourage insurers to review these updates carefully.
